Terms of Use

These Terms of Use govern the use of the “Loni – Wishlist” app and its related services. The provider of and contracting party for Loni is:

1. Scope and formation of the agreement

When you first use Loni, a usage agreement based on these Terms is formed. A paid Loni Pro purchase is additionally subject to the product, price and duration details displayed at the time of purchase and to the terms of the Apple App Store or Google Play. Deviating terms apply only if we have expressly agreed to them.

Loni is intended exclusively for natural persons of legal age. Children are the subject of family wishlists but do not use Loni themselves and do not receive their own account.

2. Scope of the service

Loni helps families manage data about children, standing wishes, wishlists and individual wishes and share them with a private group. Gift givers can view, reserve or mark wishes as fulfilled. Loni is neither a retailer nor an intermediary to a purchase contract. A status in Loni does not constitute an order, payment, transfer of ownership or binding purchase commitment to a retailer.

The specific scope of features is determined by the current app and the product information displayed there. There is no entitlement to particular future features.

3. Guest use and parent accounts

Gift givers can use Loni without a registered account. An anonymous technical identity is created for this purpose. A display name is required to join a wishlist. It need not be a legal name, but it must not infringe third-party rights or mislead others.

A parent account is required to manage your own children and wishlists. Sign-in is available by email and password and, where supported on the device, through Google or Apple. Credentials must be kept confidential. Suspected or unauthorised account use must be reported to us without delay.

When an anonymous identity is upgraded to a newly created account, existing memberships can be retained. When signing in to an existing account, data of the previous anonymous identity is not transferred automatically.

4. Display names and roles

A registered account uses one global display name. It is used for parent relationships, wishlists, memberships, reservations and the activity history. Anonymous guests select a name per wishlist.

A child may be managed by several parents. Co-managing parents may edit child data, standing wishes, wishlists and wishes. Only the account of the primary managing parent may invite or remove further parents and delete the child; co-managing parents may leave their own relationship. Anyone inviting or removing another parent must be authorised to do so within the family relationship.

5. Child data and responsibility of the person entering it

Anyone entering data about a child or another person confirms that they are authorised to do so and have obtained any required consent. Only information necessary for organising wishes may be entered. Health data, intimate information, full addresses, school or care locations and similarly sensitive details must not be included in names, notes, wish text or images.

Where parental responsibility is shared, the person entering the data must ensure that its use and sharing do not conflict with the rights of other persons with parental responsibility.

6. Wishlists, invitation codes and sharing

Every wishlist has a randomly generated invitation code. The code and its link are access keys. They may only be shared with people who should be able to view the list. Anyone forwarding a link is responsible for choosing the recipients. If unauthorised access is suspected, the invitation code should be renewed or the list disabled; support can also be contacted if needed.

Managing parents can remove gift givers or disable lists. Removing a person or voluntarily leaving deletes the membership. Existing reservations or fulfilments are not automatically reversed so the status remains consistent for everyone else.

7. Wishes, photos, links and other content

Users remain responsible for their content. Only content serving private wish organisation is permitted. In particular, unlawful, abusive, discriminatory, pornographic, violence-glorifying, misleading or malware-containing content and content infringing copyright, trade mark, personality or privacy rights is prohibited.

All required rights must exist for uploaded photos and other content. Wish photos are intended solely for non-sensitive product and wish images. Private photos of children, identity documents and other confidential content must not be uploaded. The technical image delivery described in the Privacy Policy is not a confidential family-photo or document repository.

By uploading content, the person providing it grants us a simple, royalty-free right, limited to the storage period, to technically store, reproduce, transmit and display it to the intended participants. This does not include use for advertising.

Product links lead to external providers. Those providers are responsible for their content, availability, prices, deliverability and data processing. Loni does not fully verify links or retailer details and does not guarantee that a displayed price is current.

When eligible Amazon links are deliberately opened, they may be supplemented with a general platform-specific affiliate identifier and are labelled “Ad” directly. As an Amazon Associate, Loni earns from qualifying purchases. The affiliate identifier does not cause additional costs for users. Loni may receive a commission but does not thereby become a seller or representative of Amazon; purchase contract, payment, delivery, returns, warranty and customer service remain the responsibility of Amazon or the relevant seller.

A price shown for an Amazon wish is entered manually by a parent. It is neither supplied by Amazon nor verified by Loni as current and may differ from the current shop price. Without an approved product interface, Loni does not retrieve Amazon titles, images, descriptions, prices or availability.

8. Reservations and purchase status

The status of a wish applies across lists when the same wish belongs to several lists. Gift givers may reserve open wishes or mark them as fulfilled, release their own reservations and mark their own reservations as fulfilled. They may not reset another person’s reservation or fulfilment. Parents may edit statuses to correct them.

Other participants may rely on the displayed status. Reservations must therefore be maintained promptly and truthfully. Loni does not guarantee that a gift is actually purchased, delivered or handed over, or that duplicate purchases never occur despite the status.

9. Free use and Loni Pro

At present, free use includes one child you create, one wishlist for that child and two standing wishes in each of the “Clothing & sizes” and “Always a good choice” categories. Co-managing parents and special visibility settings are Pro features. Before a purchase, the app displays the then-current scope of Loni Pro as binding information.

Depending on the store offer, Loni Pro is offered as an automatically renewing annual subscription and/or a one-time, non-consumable purchase. The price including applicable taxes, billing period and product description shown in the store immediately before purchase apply. A subscription renews for the displayed period unless cancelled in time through the relevant store’s subscription management. Deleting the app or the Loni account does not automatically end a store subscription.

After cancellation, Pro generally remains available until the end of the period already paid for. A one-time purchase is not a subscription and creates no recurring payments. It has no fixed expiry date and unlocks Pro for the relevant store and Loni account for as long as Loni is offered as a service. It is not a promise to operate Loni for the lifetime of the purchaser or indefinitely. Purchases can be restored using the provided function. Refunds and cancellation rights are governed by mandatory consumer law and the rules and procedures of the store through which the purchase was made.

The Pro entitlement is additionally assigned to the Loni account signed in during purchase or restoration. If the same store purchase is already used with another Loni account, the expressly confirmed “Check & assign to this account” function may transfer the Pro entitlement to the currently displayed Loni account. The previously assigned Loni account then loses Pro access; this does not end the subscription or purchase in the store account itself.

When a Pro entitlement ends, existing data is generally retained. Content beyond the free limits may, however, become read-only or be blocked for additional parents or gift givers until Pro becomes active again or the data is reduced to the free limits.

10. Availability, maintenance and changes

We aim to provide Loni reliably but do not promise uninterrupted availability. Maintenance, security measures, disruptions at internet, cloud, store or identity providers, and force majeure may temporarily limit use.

We may develop, change or discontinue free features for an objective reason, particularly for improvement, security, legal compliance or adaptation to technical platforms. Mandatory statutory rights for paid digital products remain unaffected; required updates are provided to the extent required by law.

Loni may be discontinued entirely only for a substantial objective reason. This includes a permanently economically unsustainable operation that cannot be continued through reasonable adjustments, permanent legal or technical impossibility, or loss of an essential platform or infrastructure where no reasonable alternative is available.

For a planned discontinuation, we stop selling new Pro products once the decision is final and notify registered users at least twelve months before the intended end, in text form to the stored contact address and additionally in a suitable form in the app or on the website. This period may be shortened only where mandatory legal requirements, serious security risks, force majeure or the unavoidable loss of required infrastructure make continued operation objectively impossible or unreasonable.

An existing one-time purchase remains usable until discontinuation. Before then, users receive a reasonable opportunity to save their relevant content or request a data copy from support. Access to server-dependent features ends with the service. Mandatory claims for subsequent performance, price reduction, refund or damages remain unaffected and are not excluded by the notice; refunds are handled under applicable law and the relevant store procedures.

11. Suspension and termination

Users can leave memberships and delete individual content as permitted by their role. A parent account can be deleted directly in the app under “Account”. Without app access, deletion can be requested at datenschutz@loni-wishlist.app. The actual process is explained under Delete your Loni account.

We may temporarily suspend or delete access or content where there are specific indications of legal violations, misuse, security risks or serious breaches of these Terms. Where possible, we provide advance notice and an opportunity to respond. Mandatory legal requirements and legitimate security interests remain reserved.

12. Warranty and liability

Statutory warranty rights for digital products apply. We are liable without limitation for intent and gross negligence, injury to life, body or health, under the German Product Liability Act, and to the extent of expressly assumed guarantees.

For a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical for the contract at the time it was concluded. Material contractual obligations are those whose fulfilment makes proper performance of the agreement possible and on whose compliance users may regularly rely. Liability for other slight negligence is excluded. These limitations also apply in favour of our agents and leave mandatory consumer rights unaffected.

13. Privacy

Information about the processing of personal data is provided in our Privacy Policy.

14. Changes to these Terms

We may change these Terms for the future where there is an objective reason, such as a change to features, costs, security requirements or the law. Material changes will be communicated in suitable form in good time. Where consent is legally required, we will obtain it. For Pro services already purchased, mandatory rights, the features agreed at purchase and the provisions on duration and service discontinuation in Sections 9 and 10 remain decisive.

15. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. Statutory places of jurisdiction remain unaffected. The contract language is German. This English translation is provided for convenience; in the event of discrepancies, the German version governs to the extent permitted by law.

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.

If individual provisions are invalid, the remaining provisions remain effective; the statutory provisions take the place of the invalid provision.
